IF YOUR MEMBERSHIP CAMPGROUND
GOES BANKRUPT
The campground owes you future services, camping privileges, if nothing
else. You are an unsecured creditor in that bankruptcy and should
immediately file a priority claim. There is no harm to the company
if they really want to survive the bankruptcy. On the other hand
- you are in line to receive compensation if they liquidate.
STEP 1: Contact the clerk in the bankruptcy court where
the bankruptcy is filed and ask them to send you several blank
"Proofs-of-Claim" forms. Keep the envelope that the blank forms
came in. If you contact us after you have the forms, we will help
you fill out the forms and anything else we can do.
Why you are entitled to file a claim: You have paid in advance for a contract with the company for them to provide future services (camping priveleges, available facilities, etc.) at an agreed-upon price. The bankruptcy will modify or terminate the agreed-upon terms, facility availablity, or policies associated to that future use.
STEP 2: Contact the Trustee's office for the bankruptcy
court where the bankruptcy is filed. Tell him that you want to
be on the "Unsecured Creditors' Committee" in that bankruptcy.
Membership on that court sanctioned committee will give you some
influence over the course of the bankruptcy and help you get information
that you can use to protect your claim. If the owner "really"
wants to get out of bankruptcy - they will want to work with this
committee very closely.
STEP 3: WORK WITH OTHER MEMBERS who are in the same situation
that you are in. Establish some kind of chain of communication
so that you can work together to help each other protect your
mutual interests.
